hedonic damages

Not medical expenses, not lost pay, and not the same thing as ordinary pain and suffering. Hedonic damages are money meant to account for the loss of enjoyment of life after an injury or death - the hobbies, routines, relationships, independence, and everyday experiences a person can no longer fully have.

Practically, this comes up when someone survives a serious wreck or other injury but life is permanently smaller afterward. Maybe they can still work, but they cannot hike, play with their kids, sleep normally, drive without fear, or handle basic chores the way they used to. On a road like US-285 near Carlsbad, where heavy oil field truck traffic can turn a crash into a life-changing event, that loss can be a real part of the case value even when the bills do not tell the whole story.

For an injury claim, proof matters. Photos, videos, medical records, therapy notes, and statements from family, friends, or coworkers can help show the before-and-after picture. A settlement or jury award may include this kind of loss under broader noneconomic damages. In New Mexico, whether hedonic damages are claimed separately or folded into other noneconomic losses can depend on the facts, the jury instructions, and how the lawyer presents the evidence.
