I used fake papers at work in Santa Fe, did I ruin my case?

It depends, but no - using false work papers does not automatically erase your New Mexico injury rights. Employers and adjusters count on fear here, especially when someone does not read English well.

The outcome usually turns on three big factors:

  • What kind of claim this is
  • How well the injury and notice are documented
  • What the employer is doing now

1) What kind of claim this is

If you were hurt on the job, New Mexico workers' compensation rights usually depend on whether you were an employee and got hurt in the course of work - not on immigration status. A Santa Fe employer cannot dodge a work injury claim just by waving around your papers after the fact.

If this was a car crash on Cerrillos Road, I-25, or another winter-ice collision involving a salt truck or work vehicle, your right to make an injury claim against the at-fault driver also does not disappear because of your status.

2) How well the injury and notice are documented

This is often what saves or sinks the case.

For a work injury in New Mexico, give notice to the employer within 15 days if possible. Medical records matter more than rumors about documents. If your boss already knew you got hurt, that helps.

For workers' comp disputes, claims are handled through the New Mexico Workers' Compensation Administration. Deadlines can be as short as one year.

If an adjuster took a recorded statement in English and you did not understand it, that is a red flag. Do not sign new forms you cannot read.

3) What the employer is doing now

If your boss is threatening deportation, refusing to report the injury, or pushing you to sign papers, that is pressure - not proof you lost. In New Mexico, intimidation is often used to make injured workers walk away.

Keep copies of:

  • any texts, threats, payroll records, and medical papers
  • names of witnesses
  • photos of the crash scene, snow, black ice, or unsafe conditions

A fake-paper issue can complicate wages and job records, but it does not automatically wipe out a valid Santa Fe injury claim.
